The Importance of Estate Planning

On Behalf of | Oct 19, 2015 | Estate Planning

Many people’s perception of estate planning is that writing a will can be a morbid affair.

However, there is nothing smarter than making a plan to protect your family.

The future is uncertain and preparing for the unknown is the only way to ensure that your wishes are fulfilled.  We wanted to take this opportunity to discuss this topic since National Estate Planning Awareness Week is October 19-25.

In Tennessee, if you have no will, your assets will be distributed according to intestate succession laws.  According to these laws, assets will be divided by specific guidelines, determined by whether or not you have living children, parents, or other close relatives when you die.

In order to take control of who receives your assets after you pass away, it is imperative that you create a will.  In general terms,  a will is simply a legal document in which you, the testator, declare who will manage your estate after you die. Your estate can consist of big, expensive things or small items that might hold sentimental value, such as photographs and jewelry. In your will, you will need to name an estate executor who will be in charge of the will after you pass.  This executor will be the person who fulfills your requests stated within the legal document.  A will is also the place where you are able to declare the person whom you wish to become the guardian of any minor children or dependents that are in your care.

Although there are many available options for a “do-it-yourself will”, the only way to have a will that will truly protect your wishes is by visiting a reputable attorney, like those at Batson Nolan, to help you make your estate plan.  An attorney will ensure the legality of your documents and be up-to-date on the latest estate laws.  In addition, reputable attorneys will be able to guide you in all of the areas your estate will need specific legal coverage.
